All forums are held at our Arvada Office from 6:00-7:30 pm.

January 7 • Bankruptcies in the Community—How do they limit an association’s rights?
Given the state of the economy, it feels like bankruptcies have become the norm and not the exception.  In this class, we will discuss how bankruptcies limit associations’ rights to collect assessments and enforce covenants.  We will also discuss steps for associations to take to protect their rights during a bankruptcy.

February 4 • Common Area Sales, Leasing, and Licensing—What do I need to know before doing it?
It has become customary for cable companies, metro districts, and other service providers to request easements, licenses, or ownership of association common areas.  Before agreeing to such a request, you need to know key provisions that could lessen implications of transferring ownership for homeowner use.  This class will focus on statutory and document specific prerequisites to the above transactions.   We will also discuss the non-legal impact of these transactions on the association and its members.

March 4 • On-Site Employees - What you need to know about employment law
Whether you have an on-site maintenance person or manager, you should not miss this class!  We will explore on the specifics of employment law pertaining to associations and their employees.  We will discuss federal and state laws associated with employment, basic  labor laws, wage and hour issues, and legal and effective interviewing and hiring.  We will also explore how to navigate the employment of staff from hiring to termination and beyond.

April 1 • Familial and Disability Discrimination - What is it and are you doing it?
Discrimination claims have become trendy in recent years.  The two most common forms of discrimination that associations are accused of are familial and disability (i.e. handicap) discrimination.  This class will focus on the elements of these two types of discrimination and how to avoid being subject of a claim.

May 6 • The Perturbing P's:  Pets, Pools, and Parking 
Regardless of what problems are “trendy” any given year, it seems “The Three P’s” stay constant.  Most communities, at one time or another, have problems with pets, pools, and parking.  This class will be dedicated to discussing these three culprits and figuring out creative ways for associations to address them.

June 3 • Maintenance & Repair Obligations - Tricks you can use to figure it out! 
Maintenance and repairs:  just when you think you found the answer in the governing documents, you find another provision saying something completely contrary!  Interpretation of documents can be tricky and difficult.  This class will provide you with tools you can use to decipher governing documents (and statutes) to figure out who has to maintain what in a community.

July 8 • Top 10 Insurance Facts - Top 10 things you need to know about association insurance! 
What are the top ten most important and least known facts about association insurance?  You’ll find out in this class.  Prepare to be surprised!  We’ll discuss some little known statutory requirements of insurance as well as the tricky provisions found in the governing documents.

August 5 • Making Tough Decisions:  What should you be aware of and how do you do it? 
Whether you’re deciding on the imposition of a special assessment or an increase to the owners’ maintenance obligations, you should attend this class.  We will provide you with tools on the decision making process, fiduciary obligations, and how these two impact each other.

September 2 • Enforcement Protocol - Are we properly fining and enforcing our rules? 
What does Colorado law require with respect to the enforcement process?  What do our documents require?  What trumps?  In this class, we will discuss the due process and other requirements in Colorado law as practical aspects of the fining and enforcement process.  You can’t afford to miss it!

October 7 • Harassment What is it and is there anything you can do about it? 
With board members and managers being at the forefront of association actions, they are the ones who get blamed when things don’t go the way owners want.  In some cases, owners can get out of control and begin to “harass” board members or managers.  What is harassment and what can you do about it?  Learn what “harassment” is and how to deal with the inappropriate behavior of owners even if it does not rise to the level of harassment.

November 4 • We’re in Court:  How do we become good witnesses?
Whether you’re testifying on behalf of the association in a collections lawsuit or a slip and fall case, you want to be as good of a witness as possible.  In this presentation, we will discuss what it takes to be a good witness and give you some tools, tips and tricks to be the best witness possible.

December 2 • Ask the Experts 
Ask the Experts is a long-standing tradition where you get to ask our panel of “know-it-all” attorneys any legal questions you want.  Take advantage of this annual opportunity to get some free legal advice.  We’ll also recap the year’s significant legal developments and provide you with our predictions for the coming year.
