January 10 • Sex Offenders in Your Community: Right to Know vs. Right to Privacy
This topic received considerable media attention last year. Join us for what promises to be a spirited discussion of what associations can and should do about a sex offender living in the community. What can and can’t be disclosed, where does a resident’s right to know end and the offender’s right to privacy begin, and what liability concerns are lurking for associations and management companies.
February 7 • New Legislation Affecting HOA's
What's Brewing in the Colorado Legislature?*
*(Due to scheduling challenges with the judge, our topic for this month has been changed.)
Join us as we take a look at bills that have been introduced during the 2008 Colorado Legislative Session and the affect on homeowners associations. We will discuss:
• HB 08-1135, Introduced by Representative Carroll which addresses the Fair Housing Act, the imposition of fines, and mediation as an alternative for resolving disputes.
• HB 08-1089, Introduced by Representative Balmer which addresses the Action Without Meeting provision of the Colorado Revised Nonprofit Corporation Act.
• Energy Efficiency Measures Legislation, Introduced by Representative Kerr. This bill does not yet have a bill number and addresses the prohibition and restriction of energy efficiency measures in common interest communities.
In addition, we'll review a recent Court of Appeals decision regarding super liens.
March 6 • Aftermath of SB100/89: What's Working, What Isn't
We’ve now lived with SB100 and its “clean-up” bill, SB89, going on three years. We’ll examine whether it’s working and how it’s changed the operation and governance of associations. What’s working well and not so well? Have
there been unintended consequences (negative or positive) of these bills?
April 3 • Spring Cleaning & Summer Breezes: Pets, Parking & Pools
With Spring upon us and Summer not far off in the distance, we’ll discuss a variety of issues that arise every year including : parking issues, pool rules and liability, landscaping and vendor contracts, and last - but not least pets - and what
they leave behind.
May 1 • Dealing with Summer Covenant Enforcement Problems
The goal is to get all residents to voluntarily comply with the covenants and rules. But as we know, this can be a challenge. What can be done to increase the likelihood of voluntary compliance? What about fines, self help and utility shut-offs? We’ll also discuss solutions to typical summer problems like painting, maintenance of yards, improvements to yards and residences, and being an election year - political signs.
June 5 • All Rise, Court is Now in Session
Testifying in court can be an unnerving experience, but it doesn’t have to be. You’ll get to observe how a typical collection trial proceeds from start to finish and see firsthand what it’s like to testify. We’ll provide you with all the essentials on how to testify so that you’ll look and sound knowledgeable, credible, and informed.
July 10 • Annual Legislative and Case Law Update
Seems like lately every legislative session results in new laws dealing with how associations are governed and operated. We’ll review what amendments were made to CCIOA and other legislation affecting associations and what it means to boards
and managers. We’ll also report on significant court cases on both the state and federal level that impact associations.
August 7 • Top 6 Most Frequent Legal Issues to Arise
Ever wonder what legal issues arise most frequently? Well, we did. So we’ve compiled a list of the most frequent legal issues that boards and managers have come to us with over the past three years. We’ll share with you (for free) the context of these issues and both the legal and (with your help) the practical solutions.
September 4 • Ins and Outs of Annual Meetings
With the majority of annual meetings approaching, issues such as nominations, balloting, proxies, quorums, voting challenges and budget approval take on added
importance. Conducting an orderly (and lawful) annual meeting is not always as easy as it sounds. We’ll discuss these issues and how they play a role in the recipe for a successful election of directors.
October 2 • It's That Time Again: Dealing with Holiday Decorations
Learn how to guide your community through the holiday season and not become the Grinch. Join us for a spirited discussion on holiday decorations. Learn how to respond to Halloween ghosts and witches, Thanksgiving turkeys, Christmas lights, Hanukkah candles, nativity scenes, Easter bunnies, and other decorations without extinguishing the holiday spirit. We’ll discuss ways to insure that the restrictions you impose are reasonable, fair and accepted by the community.
November 6 • Let it Snow, Let it Snow, Let it Snow (But Not Too Much)
Hopefully, this winter will not be as severe as last winter. Regardless, there will still be a host of issues related to the cold and snow. We’ll discuss legal issues arising from frozen pipes, slip and falls, failure to plow, damage resulting from plowing, and the difference between how the duty to maintain and the duty to insure impacts these issues.
December 4 • Ask the Experts
This is your opportunity to ask our panel of know-it-all attorneys any legal questions you want – hopefully related to homeowner association law. Take advantage of this (rare) opportunity to get some free advice. We’ll also recap the year’s significant legal developments and provide you with our predictions for the coming year.
